Spring Car Care Tips From The Aggressive Trial Lawyers In Northwest Indiana

It is now spring time in Northwest Indiana (we hope the rain eases off), a good time for aspring cleaning of your vehicle and a great time to ensure your vehicle is safe for the upcoming summer driving season.  The attorneys and staff at the Merrillville, Indiana law firm of Schlyer & Associates have a few things for you to consider doing this spring to your vehicle.

If you are mechanically inclined, with the right tools and know how, we have prepared a simple list of items you should do to make sure your vehicle is in good working order this year.  If you are not very mechanically inclined, and if you do not have the right tools or know how, please schedule an appointment with your mechanic or dealership for a spring check-up of your vehicle.

Schlyer & Associates have listed a few helpful ideas you (or your mechanic) should check and / or do to your vehicle.
Batteries: Test and replace old or weak batteries, especially those more than three years old. Winter can be very hard on vehicle batteries.  It can be cheaper than a tow and replacement on the road.

Tires, wheels: Cold weather can reduce tire pressure, so make sure all tires, including the spare, are properly inflated and balanced, and wheels are properly aligned. Inflate tires to their recommended pressure - check the inside of your vehicle door to find out what the proper air pressure should be. Under-inflated tires can reduce fuel economy by up to 3.3 percent (very important when gas is $4.00 a gallon) can  cause premature tire failure and are a safety hazard.

Belts and hoses: Inspect and replace worn or cracked belts, as well as hoses that are blistered, brittle or too soft. Belts and hoses older than five years, even if they look intact, might need to be replaced.

Brakes: A spring checkup can uncover any winter damage. Inspect the brake system, including lines, hoses, and parking brake. Inspect brake fluid for proper level. Low brake fluid can be an indication of excessive brake wear or fluid leak. Have the brake linings/pads inspected and measured.

Suspension: Deep potholes aren't friendly to shocks and struts. An inspection to determine wear or leaks can alleviate bigger issues down the road.
Inspect the antifreeze/coolant level, making sure the coolant used meets the specifications listed in the vehicle owner's manual.

Oil Change: Check oil level regularly and change the oil every three months or 3000 miles, whichever comes first, for top performance and longer engine life.

Check the transmission fluid for correct level. Check the owner's manual for the right type of transmission fluid to use and the proper interval for service and replacement. Watch for leaks that can cause your transmission to fail.

Inspect power steering fluid for proper levels. Low power steering fluid can cause damage to the power steering system and lead to premature power steering failure.

Inspect windshield wiper blades for wear and cracks, ideally each spring and fall. GM recommends replacement of blades that look worn. Also inspect and replace the rear wiper blade, if equipped. Don't forget to check the windshield washer fluid.

Inspect and replace the engine air filter and the cabin air filter: Replace as necessary.

Inspect steering components and steering linkage: Replace as necessary.

Apply a protectant: Any vinyl surface including the dashboard, seats and the steering wheel are susceptible to cracking, sun damage and fading — be sure to apply a protectant at the beginning of the season and touch-up regularly.

Interior clean-up:  Vacuum, vacuum, vacuum! Be sure to throw away any unwanted garbage that has hibernated under your seats over the winter. And now is the time to store your winter vehicle mats in the garage.

Wash your vehicle: Most important, right?   A clean vehicle runs better, right? Not necessarily, but it does make the vehicle look better.  Just like a good maintenance program prolongs the life and performance of your vehicle, all vehicles regardless of the finish (clear coat, acrylic, enamel, etc.) require regular washing throughout the year. To preserve your vehicle’s shine and protect the surface, wax your vehicle once it has dried completely.

Clean the underbody: Do not forget the underside of your vehicle.   In addition to washing the exterior, be sure to spray the underbody and underneath the rear and front bumpers to rinse away any salt build-up which can lead to erosion and rusting. Use a high-pressure sprayer or garden hose for best results.

The Truths About Filing An Affordable Bankruptcy

With a mind toward declawing the monster, here are a dozen misconceptions about filing or declaring bankruptcy:

1. Everyone will know I've filed for bankruptcy. Unless you're a prominent person or a major corporation and the filing is picked up by the media, the chances are very good that the only people who will know about a filing are your creditors. While it's true that bankruptcy is a public legal proceeding, the number of people filing is so massive that very few publications have the space, manpower or inclination to run all of them, although some local newspapers do print the names of those who have filed in that community.

2. All debts are wiped out in Chapter 7 bankruptcy. You wish. Certain types of debts cannot be discharged, or erased. They include child support and alimony, student loans, restitution for a criminal act and debts incurred as the result of fraud.

3. I'll lose everything I have. This is the misconception that keeps people who really should file for bankruptcy from doing it, says Chris Viale, the chief operating officer of Cambridge Credit Counseling in Massachusetts.

"They think the government will sell everything they have and they'll have to start over in a cardboard box," Viale says.
While bankruptcy laws vary from state to state, every state has exemptions that protect certain kinds of assets, such as your house, your car (up to a certain value), money in qualified retirement plans, household goods and clothing.

"For most people, they'll pass through a bankruptcy case and keep everything they have," says John Hargrave, a bankruptcy trustee in New Jersey. If you have a mortgage or a car loan, you can keep the property as long as you keep making payments (like the rest of us).

4. I'll never get credit again. Quite the contrary. It won't be long before you're getting credit card offers again. They'll just be from subprime lenders that will charge very high interest rates. "There are innumerable companies that will provide credit to you," says California bankruptcy attorney and trustee Howard Ehrenberg.

5. If you're married, both spouses have to file for bankruptcy. Not necessarily. "It's not uncommon for one spouse to have a significant amount of debt in their name only," Hargrave says. However, if spouses have debts they want to discharge that they're both liable for, they should file together. Otherwise, the creditor will simply demand payment for the entire amount from the spouse who didn't file.

6. It's really hard to file for bankruptcy. It's really not. Technically, you don't even need an attorney -- you can do the paperwork without one. However, going through the procedure alone is not recommended.

7. Only deadbeats file for bankruptcy. Most people file for bankruptcy after a life-changing experience, such as a divorce, the loss of a job or a serious illness. They've struggled to pay their bills for months and just keep falling further behind.

8. I don't want to include certain creditors in my filing because it's important to me to pay them back someday, and if the debt is discharged, I can't ever repay them. Bless you for even thinking about such a thing. You're no longer obligated to repay them, but you always have the opportunity. If your conscience won't let you sleep because you didn't pay your debts, there's nothing in the bankruptcy code that prevents you from doing that once you're back on your feet. But it is nearly impossible to leave any account with a balance out of your list of creditors. In general, all creditors receive notification of your bankruptcy filing, whether they are listed in the petition or not.

9. Filing for bankruptcy will improve my credit rating because all those debts will be gone. Filing for bankruptcy is the worst "negative" you can have on your credit report. Unlike other negatives, which stay on your report for seven years, bankruptcy can be there for 10 years, but you do get to rebuild your credit eventually.

10. You can't get rid of back taxes through bankruptcy. Generally speaking, this is true. However, there is such a thing as tax bankruptcy.

11. You can only file for bankruptcy once. The truth is, you can file for Chapter 7 bankruptcy only once every eight years, says Justin Harelik, Bankrate's bankruptcy adviser. For Chapter 13 reorganization, you can file more often than that.
Of course, that doesn't make it a good idea.

"Multiple bankruptcies are really bad," Rosenberg says. "Many people get into the habit of once they've done it, it becomes a way of life. This is not good for your karma." Or your credit rating.

12. I can max out all my credit cards, file for bankruptcy and never pay for the things I bought.That's called fraud, and bankruptcy judges can get really cranky about it.

Dr. Mehta-Paul Missing For 2 Years


An article regarding our former personal injury client, Dr. Mehta appeared in today's Times, which is found below.

Investigation now a cold case



MUNSTER | Promila Mehta-Paul’s Munster home was once swarmed with investigators searching for evidence that could lead them to her.

Two years later, the brick house stands as a quiet reminder of the missing person investigation that has become a cold case.

This week marks two years since Mehta-Paul was last seen alive — on March 21, 2011 while making a deposit at a Highland bank. Police have said they believe she is dead.

Viewed from a window, a few items Mehta-Paul probably used remain inside, such as a cream couch, a bicycle and a connected telephone. An outside garage light still turns on automatically when someone walks by.

In the initial months of the investigation, law enforcement officials searched for Mehta-Paul using horse-mounted volunteers, they used sonar equipment to look in a nearby lake and offered a $20,000 reward for tips.
Nothing led police to Mehta-Paul.

Munster police Detective Sgt. Ray Schweitzer said the agency only actively investigates the case when tips come in, usually from other law enforcement agencies.

Mehta-Paul’s eldest son, Paul M. Fontaine, remains the primary person of interest in the case, authorities said.
Fontaine, 40, is in the Westville Correctional Facility until April 2014 on forgery charges stemming from when he tried to sell his mother’s vehicle six months after she disappeared, according to the Indiana Department of Correction’s website.

Munster Detective Mike Janiga said Fontaine was the last person to see Mehta-Paul alive and he gave conflicting statements to people about the disappearance.

Schweitzer said it’s up to Lake County prosecutors if charges will ever be formally filed against Fontaine. He said there have been cases where people were charged even if the bodies were never recovered.

“It’s really frustrating,” he said. “It’s like knowing who stole your purse but not being able to prove it.”

Not much is known about what Mehta-Paul’s life was like before she vanished. She would be 72 years old today.

According to records, she graduated from the Christian Medical College in Ludhiana, India in 1965. She also attended the University of Madras and Punjab Medical College.

Records indicate that by 1975, she had applied for a license to practice in Illinois. She worked as an ophthalmologist and had her own practice on Kennedy Avenue in Highland. The business still looks the same, except now it has a Realtor’s sign outside.

Court records indicate she may have had financial troubles. In 1999, a lawsuit against her Merrillville attorney claims she was forced into bankruptcy after she fell at his office and couldn’t work because of pain she suffered.

Many of Mehta-Paul’s neighbors say they didn’t know her well and declined to comment.

Neighbor James Stout said Mehta-Paul had lived in the same house for about 20 years. He saw her three sons grow up alongside his children, and he often bumped into her at school meetings.

As the children grew into adults, Stout saw less of Mehta-Paul. He occasionally would see her working on her garden.
“Everyone would like to know what happened,” he said.

A sense of closure in the case could come through the National Missing and Unidentified Persons System.

Todd Matthews, the director of communications for the database, said Mehta-Paul is in the database and law enforcement officials and coroners’ offices have access to DNA and some dental records.

“She could already be a Jane Doe in the morgue,” he said. “It’s a possibility.”

Matthews said the database, used by agencies across the country, contains 31 unidentified cases in Indiana and 97 missing person cases in the state.

Kenna Quinet, an associate professor at Indiana University-Purdue University Indianapolis, said most missing persons cases involve juveniles and result in a successful reunion.

Quinet said technology and databases like NamUS has helped to decrease the volume of missing person cases.

Mehta-Paul is not a person likely to disappear, Quinet said. In her research, the most vulnerable people to go missing are homeless or prostitutes.

She said cases like Mehta-Paul's are harder to solve the longer the case remains unsolved. "Evidence fades with time," she said.
